These Terms & Conditions (“Terms”) govern your stay at Waterfall Villas (“the Resort,” “we,” “our,” or “us”) and your use of our website, booking systems, and services. By making a reservation, staying at our property, or interacting with our services, you agree to be bound by these Terms.
1. Reservations & Payment
1.1 Booking Confirmation
Your reservation is confirmed only after you receive a written confirmation from the Resort.
1.2 Payment Requirements
A deposit or full payment may be required to secure your booking.
Payments must be made using the accepted methods listed on our website or booking partners.
1.3 Pricing
All rates are quoted in the currency shown at booking and include only the services explicitly listed. Additional taxes, fees, and surcharges may apply according to Costa Rican regulations.
2. Check-In & Check-Out
2.1 Check-In
Guests must provide valid identification upon arrival.
2.2 Check-Out
Late departures may incur additional charges.
3. Cancellation, Changes & Refunds
Unless otherwise specified in your booking confirmation:
3.1 Cancellations
Cancellations may be subject to fees depending on how close the cancellation is to the arrival date.
3.2 Changes to Reservations
All modification requests are subject to availability and may affect the final room rate.
3.3 Refunds
Refunds, if applicable, are processed to the original payment method. Bank or currency exchange fees are the guest’s responsibility.

4. Guest Responsibilities
4.1 Conduct
Guests must behave respectfully toward staff, other guests, wildlife, and property. The Resort reserves the right to remove guests who engage in dangerous, illegal, or disruptive behavior without refund.
4.2 Damage to Property
Guests are responsible for any damage, loss, or excessive cleaning required as a result of their stay. Applicable charges may be added to the final bill.
4.3 Personal Belongings
Guests are responsible for securing their belongings. The Resort is not liable for loss, theft, or damage to personal items unless required by law.
5. Resort Environment & Activities
5.1 Natural Setting
Waterfall Villas is located in a natural environment that may include uneven terrain, wildlife, water features, and weather-related risks. Guests participate in onsite and offsite activities at their own risk.
5.2 Wellness, Spa & Adventure Activities
Some services may require signing a waiver. Guests must disclose relevant medical or physical conditions to ensure safety.
6. Third-Party Services
The Resort may recommend or arrange transportation, tours, or services provided by third parties. These services are independent of the Resort. We are not liable for any injury, delay, loss, or dissatisfaction arising from third-party providers.
7. Website Use
7.1 Accuracy of Information
While we strive to ensure the accuracy of information on our website, we do not guarantee that all content is error-free. Prices, descriptions, and availability may change without notice.
7.2 User Obligations
Users may not misuse our website or engage in actions that could harm the system or disrupt access.
8. Privacy
Your use of the Resort and website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.
9. Limitation of Liability
To the fullest extent permitted by law:
The Resort is not liable for indirect, incidental, or consequential damages arising from your stay or use of our services.
Our total liability for direct damages will not exceed the total amount paid for the reservation giving rise to the claim.
10. Force Majeure
We are not responsible for failure to perform obligations due to events outside our reasonable control, including but not limited to: natural disasters, pandemics, power outages, transportation interruptions, civil unrest, or government actions.
11. Governing Law
These Terms are governed by the laws of Costa Rica. Any disputes arising from your stay or use of our services will be subject to the exclusive jurisdiction of the competent courts in Costa Rica.
12. Amendments to Terms
We may update these Terms from time to time. The updated version will be posted on our website with the “Last Updated” date. Continued use of our services indicates acceptance of the revised Terms.
